Every YouTuber, especially the partnership members, knows the dilemma: Using popular music as a background increases the views, but as someone else owns the rights, all kinds of trouble may arise if you simply use a suitable mp3 file you have on your harddrive. Not being able to commercialize the video is a given, but you even risk a complete shutdown of the clip and even penalties. YouTube has advanced auto detection software that is obviously very quick, and good.

So offers from professional audio suppliers are indeed very tempting. I fell for such an offer very recently - during the first ever recorded usage of a chainsaw as ammo, I wanted "Hallelujah" from Händel playing gloriously in the background.

So I found this website:

See the offer on the www.proudmusiclibrary.com website

Sounds very attractive indeed. For 53,50 Euros, "most commercial uses" are OK, and YouTube video uploads are specifically listed. The exceptions listed on the site did not apply.

I went ahead and did the deal. The song download access was swiftly granted, and I was a happy camper.

But the nasty surprise was just around the corner. YouTube did not allow me to commercialize the video, because of "third party matched content". In other words, someone else claimed to have the rights on the music.

Three different "owners" (Believe, Muyap and INgrooves) obviously prevented my video from making money for me.

As the money from such YouTube ads is the ONLY income I make from my channel and I need the funds for the materials I use, this is a desaster.

So I filed a dispute, as I had the perfect paperworks. Also I contacted Proudmusic.

Within a few days, the video saw many many thousands of views (about 250k so far) - all not making any money for me. Two of the three prospective "claims" were dropped over time, but the third one, "Muyap", still blocks the monetizing option of the video. This has caused damages worth several hundreds of Euros. And counting.

I wasn't happy about it, and asked the owners of ProudMusic for a refund. The loss of the ad money was far higher than the 53,50 I had paid for the music license, but I really wasn't happy with the deal and thought that getting my money back was the least the guys can do.

But they were reluctant. After a few harsh emails back and forth, they "generously" offered half of that money. Not even a thenth of the sum I lost because of the misleading info on their website.

It turns out that they can give you a license, but can't prevent others from claiming the rights to YouTube. As YouTube can of course not be the judge in copyright fights, they simply block the monetizing option for disputed videos and leave it be. Understandable.

They don't tell you about this BEFORE you buy a license. Of course not, as nobody would consider buying a license in the first place otherwise. So they give you the impression that all you have to do is to cough up 53,50 and you are all set. This is misleading, in my humble opinion.

So. Don't. Do not. Not even when it really itches. Go and buy a music license from any of the providers if you want to make some money with your YouTube video.

And spread the word.

Yes, a rather nasty issue. The entire copyright situation is a pain in the rear end, globally.

Bastards! What I don't agree with is YT shutting you down, taking the other guy as having the true rights to the song. Why is his "proof" better than yours? For this reason, YT shouldn't block you or others like you as they are not able to legally determine whom has the license to the song. If your use is in dispute, then the party lodging the complaint should have to produce legal proof that supersedes yours. But until this is produced, you should not be kept from using what you have payed for to make money with. YT is in bad territory here. And in the case that the entity you purchased license from in fact did not have rights to sell it to you, they should owe you not only a refund, but damages for lost revenue. Have you checked with a lawyer? Germany is much more progressive than North America with it's consumer protection laws. Here, we're at the mercy of influence peddlers and politicians on the take.
Sorry to here about this Joerg. Sadly, gone are the days of ethics and the hand shake.

You should erase "The music piece "Hallelujah" has been licensed from ProudMusic/ Ingelheim, Germany" from the comment and make them bad publicity instead. A lot of people watch your channel and everyone knows you' re an honest man.

tokSick, you are right, I have updated the text description accordingly.

Bert, I did exchange some nasty emails with the owners. In the end, I tole him "Shame on you, and put the 26,75 you so generously offered to a place where the sun don't shine".

Zwillie, I'd love some music!

This is the endless discussion over
licences in Germany. The GEMA will decrease the fun factor in Germany.F**** the GEMA. You used not an actually sound file.Händel wouldn´t turn in his grave with using his sound file. You are honestly to buy a license and they compromised you.

It's very difficult to add any sorts of music to youtube videos. Even music I have made myself is rejected because not enough sufficient data is presented no matter how many details I provide. It's almost impossible to have any music accepted because people get panties in a twist over copywrite laws.
