Patents anyone?

    As 'the thread' has been removed from the view of us common folk on the other forum I wondered how people might feel about resuming it here.

    It does seem to me that the freedom of members to continue to make a standard and commonly used construction technique has been threatened.

    But maybe everyone is fed up with the subject ?

    Ah...there has been a big brouhaha over one member's attempt to patent a standard construction technique. Let's see if people want to resume the topic and if so we can give the info

    ruthie we've been discussing this foolishness for a couple days now. old spook went on a diatribe about being banished and it went to hell in a handbasket with people from the other forum goining here just to continue the argument. We're all pretty tired of it. Only someone looking to sell them would be infringing on the patent which will never be issued. Ill thought power grab in my opinion. The threadjacker crew stepped in and handled it with mass recipe bombing.

    Hey Ruthie,

    here in our country (i think even EU-wide) a patent has to be s.th. that exceeds
    the effort of a few hours of work of a specialised worker.
    A "small" patent would be a "Gebrauchsmuster" utility model/petty patent. This
    has to be modified only a little bit to become another "utility model"..

    Of course you can open a thread about that patent issue here. In fact you already have! :)

    My opinion is quite clear. Jim Harris has a right to try for a patent, and should he get it, then he has the right to exploit it.

    Others have a right to find ways around his patent.

    Others have a right to fight it in court.

    Others have a right to despise him for what he has done, and stop buying his products. Then, the patent may quickly expire due to the lack of the ever increasing annual costs to maintain it.

    Time will tell.

    I'm getting the patent to the action of" sitting on the toilet to make the number 2"......
    So if you don't want to pay me money or get pursued, you must do it standing from now on!

    I've already got a work around from reverse engineering making number 2. Until I have the method perfected use at your own risk. It involves a 5 horsepower Wet/Dry Vacuum a Garden Hose and a Bristle Brush. It's a two handed operation so I have not posted any videos on it yet. Use your imagination.

    Actually BV, I requested a change with the copyright office. #2 is now known as #5, and I applied for a patent on the sitting procedure for #5. I guess I may have to see you in court :cool:

    I did see the thread at the other site and left a comment there. I'm in agreement with Joerg, as long as no one is trying to produce off another's patent for commercial purposes, there is no reason the folks who wish to make their own cannot do so. I have nothing against someone who wishes to try and patent a marketable idea, I'm all for capitalism. If he's got the financial resources and the wherewithal to do it, then go for it. I think the big problem was how Mr. Harris handled it in the private messages to certain members who were no threat to his business, which was prompted by his attorney.

    EDIT: I'm all for capitalism, as long as it doesn't stifle individual builders from pursuing their hobby. The law does not do that, an ill-informed entrepreneur attempted to do that. Hopefully he's learned a valuable lesson from this.

    D's right, this got some big discussion last week when a few folks from SSB came here and started a big ruckus over the whole thing, which got very tiring. It was less a discussion on patents and more an airing of grievances between certain members from SSB. Check out the thread titled "oh my...I seem to be banished..." and you can see how it all played out.

    It is a good question though, one worthy of discussion, and potato soup recipes ;)

    I think that Patent he wants is bulls##t. Its nearky like wanting to get a patent on the wheel. Slingshot Knifes, etc are all laminated with bolts. Even if he gets it, many people will stop buying his stuff cos they are pi##ed of by his behaviour. I think he Made a big mistake.

    I'm a big fan of Käsefondue myself. There is a local German restaurant here, Gustav's, that makes really awesome Käsefondue mit wurst und bröt - so good, it's hard not to make that your whole meal. But then their Jaegerschnitzel and spaetzle is hard to resist too.

    Dang it! Now I'm hungry for fondue and it's only 6:30 am here! :mad:

    When looking at a patent, the "claims" are the most important parts. They define what is covered. The rest of the patent is blah blah with little relevance.

    Jim's claims:

    OK. We are talking slingshots with two arms only,no knives, no stickshots. This further means that the metal core must be in the middle between two outer layers. If you have a middle layer made from wood, then two metal layers, then more layers to the front and back, no infringement.

    This means that if you don't use spacers between the middle (metal) core and the outer layers, no infringement.

    This means if you use no pins or just one pin, no infringement. Laminated frames (like Nathan's) don't infringe.

    So the patent application only covers slingshots with a middle layer from metal, two spacers, two outer layers, and two or more pins to hold things together.

    In all fairness I do not think I saw such a slingshot before Jim brought his models out. Most metal core slingshots don't have spacers. And most are laminated, not pinned. So maybe he WILL get his patent.

    But it will be easy to circumvent it.

    Sorry my friend but you will have to pay me because I have a running patent for the #1 before you claimed #2 ... and to reach the #2 it must pass #1 first and you will be infringing my property unless we agree a royalty for #2 after #1 ... :p
